Rain

We've had several renters leave early because of rain. I don't get it, personally. Our official line is we don't refund due to bad weather unless a mandatory evacuation is declared, although we typically work with people when we can--if they are nice about it and don't act like the weather is somehow our fault.

Recently we had one person who wanted to cancel because the forecast called for a 60% chance of rain. First, she lied to us and claimed that she had heard (in Texas, no less) that Walton County was under a mandatory evac. due to TS Cindy, which was hitting Louisiana that day. Would have been funny except that we then spent a couple of hours on the phone on a Saturday trying to verify the truth of it (she later came clean and admitted she simply didn't want rain to "ruin" her trip). Since this was on her check-in day, we told her she could not cancel, but offered to shift her check-in/-out days around. No response until after her scheduled check-out when she demanded a full refund. After her and our attorneys got into it, it was concluded that--due to a loophole in our rental agreement--we would have to refund her. For her, the worst part was that the weather was beautiful the whole time she missed. The worst part for us, though, was we lost the rental, spent money on attorney fees and are now spending even more money on even more attorney fees to tighten up the rental agreement...at a time when we are already losing money hand over fist due to Dennis-related cancellations.

As Tim Robbins said in "Bull Durham"...sometimes it rains.

As for "Office Space"--great movie, one of my all-time favorites and one which I didn't expect to like going into it. Stephen Root (the stapler man...also the blind DJ in "O Brother, Where Art Thou" and Jimmy James on "News Radio") is one of the most underrated actors in da bidness, in my opinion.

Sounds like you were better off not having her stay at your place...if she was that arrogant about demanding to cancel because of a chance of rain, no telling how she might have treated your home had she decided to come!

Just curious...what was the loophole?

The agreement put forth terms and conditions about what happens if they cancel 30 days prior (they lose the deposit, but not the rental fee). It did not, however, specifically address the case where they cancel on or after check in (although there is a paragraph that says that early check-outs are at our discretion). We considered her a no-show since, after our offer to adjust dates we heard nothing else from her, but our attorney (along with another one in her office) said that a judge would likely rule it as a cancellation 30 days prior.

Sounds like you need to change the retention of deposit to include cancellations made 30-10 days prior, and add that cancellations from 9 or less days prior will be charged full amount, since it is difficult to rebook, eh? I am curious as to what the new terms will read so please give us a heads up when you find out.

Tell me where she lives and if it is close I will TP her house! What a Wendy Whiner! People like that can go jump in a lake...just not a lake in SoWal!

I'd rather be there in the rain than just about anywhere else! I am playing the world's smallest violin!!!!!
